Default Stuck In A Bad Business Deal...

A while back I purchased a (supposed) 3.70 rear end from a forum member. The rear end was a rebuilt one and I paid $675 for it. Whenever I received the rear end, much to my dismay, I discovered that it had 37 teeth on the ring gear and 11 teeth on the pinion gear...indicating a 3.36 rear end. I should also mention that it was a really nice rebuilt rear end....but I wasn't looking for a rebuilt 3.36 (I have one). I e-mailed him to talk about this and he said that he would gladly take the rear end back and refund my money. I packed the rear end up and shipped it back to him (cost me $75 more out of my pocket), this was on 11/14/01. He e-mailed me to let me know that he had received the rear end.

A few days later I e-mailed him asking him if he had gotten a chance to send the $675 back. He said that he ran into some financial problems and doesn't have the money right now. To make a long story short it is now 12/11/01 and I am still without my money. His e-mail responses have been few and far between and lately he doesn't seem to return any of my e-mails. I really feel for his financial status, but when push comes to shove I too have to pay the bills...and if I don't make my monthly car payment on time, bye-bye 'Vette, not to mention Christmas is coming up and I still have a bunch of shopping to do for the family. :cry .

I don't think he would rip me off, he really seems like a nice guy. But he has had the rear end in his possession for nearly a month and also has my money. What do you guys suggest I do? Should I sit it out and wait to see if he'll come through with the money? I posted here because I could really use your input.

Bence,

Don't stop sending the E-mails. This guy needs to know that you need your money just as bad ( if not worse) than he does.
Try to tell him kindly (which I'm sure you already have) that you are not a bank and are entitled to your money back and that maybe he should go visit a bank and set things right.
This time of year (Christmas), we all could use a little extra cash. but to take advantage of you in this way is way out of line.

If that don't work, then get mad. Post his name on the forum and we'll all bombard him with nastygrams. Maybe then he will get the point.

Gotta love this forum. Nicest guys in the world until you screw a memeber the wrong way. :D Its like a big family. I love it(Im not being sarcastic).

Anyway benece, I agree, keep them going, Im sure this guy is good on his word, and will refund your money. The reason you keep the e mails going is so he doesn't forget.

Bence: That sucks. Like others have said, unfortunately he probably doesnt even have the money. That doesn't make it any more right, but I guess it just means you'll have to keep bugging him, maybe he can pay you back a bit at a time?? He's probably living paycheck-to-paycheck.

But we must realize a few of them where from the same person, and that person seems to have dissapeared. The integrity of the forum is still there IMO. 2 sour people will not make me choose e-bay over the forum from now on.

If he didn't have the money, he should have been up front about that before you sent the merchandise back. As it stands, you don't have anything. If he would have been honest, you could have at least sold it on and gotten most, if not all, of your money back. He could sell it on ebay within 7 days and get you your money back. This guy isn't being honest with you. You should post his name before he does this to someone else.

I -do- agree with everyone, you deserve to get your money back, now and not when it's appropriate to the person who gipped ya. However, here's a question: How were you expecting to tackle the holiday season and paying bills if this rear end were to work out? Makes me wonder about you, actually, if you're not trying to do this to cover your own butt...
You gotta pay if you wanna play, you know? I repeat, how did you intend to pay your bills if this rear end were to work out? I mean, if it was an actual 3.70, you'd have to pay somehow? The reason you're up doo doo creek is because -you- bought something you couldn't afford.
Just calling it as I see it, no hard feelings man.

I know some may disagree with this but I NEVER buy anything for my car sight unseen. It's just much easier to get recourse if you deal with a company. I'm sure you can get some good deals but the risk is just too great for me because I can only afford to pay for something ONE time. I have a friend who LOVES swap meets. Thing is, he always has a bunch of parts, a couple of "projects" but never a good, solid running car. The $$$ he spends on "deals" he could buy new and have a decent vehicle. A parallel to your situation, is I had a company bend me over for over $600 in rear suspension parts but I was able to get reimbursed through my bank. Sometimes a little extra $$$ can buy piece of mind.

Heh thats too bad about your deal I guess hind sight is still 20/20 You should have tried to resell the rear end save the $ 75.00 in shipping and let the new buyer pay it.

He could be a person who just ran into some urgent financial matters such as sudden medical bills, a lay-off, etc. If indeed he is basically an honest person, you may wish to suggest that he pay $200.00+ dollars per month for the next three months. Surely he will sell that rear-end and cover some of his obligations, including the one he has to you. I am not a fan of condemning/spamming people until options have been offered and even better, his description of the circumstances. We live in terribly difficult economic times and personal/family circumstances can change in a blink of the eye. Two weeks ago a friend went to work for 8:00am and was escorted to the front door by 8:30am.
