The only reason im doing this is because of the most recent thread about both of these cars on track thread. I know GM has these "black Boxes", but this one is different in the GT-R

You are right. Here in CA they are, and have been trying to come up with the new OBD-III they would like to make it to where your car's emissions are constantly monitored (like they are now) but with OBD-III it will notify DMV and you, to tell you your car is out of spec and polluting and you better fix it now.
With the strict statements in the GTR's manual, I wonder, if at all, are the dealers being informed that any warranty repair requests, with VDC off being found during anytime of the failure, that they will not be covered by nissan and thus having your warranty voided?

Nissan's data recording system will probably be a major factor if people are willing to by a car that is built to be driven hard (why else would it be fitted with launch control) and yet have it's warranty voided due to using the car according to its built spec.?

This is a topic that is related to the Z06. If one manufacture can void warranty issues by reading the box, what will prevent another manufacture from doing the same. The Z06 does have a black box but the question is, what and when will they use this data? Are there any legal rights?

True. The same applies for the Z06. It's like taking the car to the drag strip, shutting off the traction control completely, doing a hard launch and having the drivetrain take a dump.
Should GM warranty it? The Z06 is meant to be driven hard. Why would they give you the option of shutting off the traction control completely?
We know that Nissan and GM will not cover warranty repairs for drag racing or road racing. There is a thin line with road racing events for educational purpose.
But if you shut off the nannies and something goes bad at these events, the manufacture can void the repair warranty. The only difference is that Nissan will look at the driving history from the box. But will GM do the same in the near future?
Is there any way to tell what brands and years have these things? Is everything from 2008 and older safe from such elektronik eavesdropping? If so, I may have bought my last new car!
