Default penalty for unregistered vehicle in NY?

aMy dumb-*** was caught driving an unregistered car with switched plates in NY. I at least was smart enough to have insurance for the car. Any idea what penalties I could be facing?

I have an absolute clean driving and criminal record.

Any ideas?

Unless you want to hear a long and pitiful sob story, don't ask why I didn't register my car.

They impounded the car, but I fixed my registration the next day and picked up the car.

I know the max possible penalties, but what is the most probable punishment I'll receive?

anyone been through this before?

Don't know about NY, but switching plates can be a felony in California.

I'm hoping that my sob story will help.

I'm a 70% disabled vet (due to PTSD from Iraq), father of two little girls, and I'm in the process of losing my house (I'm 3 payments behind). I needed to get to work and I just don't have the money to register the car.

The felony part scares me.

It's a felony in Michigan as well, AKA Document Fraud. Google can probably tell you what the story is in NY, but it's a fairly serious crime. The unregistered vehicle charge is usually a ticket, attempting to pass the vehicle off as a registered one is where the penalties really kick in.

1st offense and you'll be fine...literally, you'll get a fine. Not like you where doing anything illegal with it and you even registered it. Times are tough and judges know this. I wouldn't smack you down for it in this instance.

Thats what I'm hoping for. Otherwise, a felony will cause me to lose my job and I'll really be screwed.

Get out the Vaseline, your getting screwed! Funny how you found the money to register the car after the fact? You will probably only get a hefty fine.

You'd be lucky if you were in NJ, where not having your vehicle registered is actually a much smaller fine than having it registered, and simply not having the card with you.

My buddy just went to court here in GA for that. He's paying $1100 in penalties! No schit!

Subsection 1 of NYS VAT section 401 states that no motor vehicle shall be operated or driven upon the public highways of this state without first being registered.

Subsection 18 discusses the penalties for driving without registration. Here it states that a violation of subdivision one of this section shall be punishable by a fine of not less than seventy-five nor more than three hundred dollars, or by imprisonment for not more than fifteen days, or by both such fine and imprisonment except, if the violation consists of failure to renew a registration which was valid within sixty days, the fine shall be not less than forty dollars.

So to simplify this legal talk it means that the penalties for a violation driving without proper registration on a vehicle in New York can be punishable by a fine of not less than $75 nor more than $300 or by imprisonment for not more than 15 days or both. If the violation consists of failure to renew a registration which was valid within 60 days, the fine shall be not less than $40.

Good response. Finally someone took the time to Google the possibilities. Looks like those posting subsequent to this might want to remember that RIF.

Well, that's a pretty good sob story. I hope it works out for you. I ain't no judge, but to me the fact that you had insurance is a huge mitigating factor.


I would save my wrath for the unregistered/falsely registered vehicles that are stolen, driven by unlicensed drivers and uninsured.
