This is ridiculous. I sent a note to my MP, suggest that we all do the same. Let us use the power of the internet rather than sit back and do nothing. The only way that change can happen is if we make it happen.

The Carter Defense
In Canada the legal limit for operating a motor vehicle after consuming alcohol is .08 blood alcohol level. Police routinely test for this with a breathalyzer, a small hand held machine that the accused breaths into. Unfortunately in Canadian law there is also a loop-hole, the Carter Defense, which has been around since 1985. According to this defense, the breathalyzer is only a machine that can malfunction. If the accused testifies under oath that he/she has only had "one or two drinks and can therefore not possibly be impaired" that statement raises a reasonable doubt as to their guilt. The accused must then be acquitted. Yes, machines can malfunction, but accused people can also lie.

Hey and in a world of fairies, tinkerbell and peter pan, the Carter Defense...
In the real world you are presumed innocent until proven guilty...but we know that also is a fairy tale. As a citizen I would like to see the carter defense used and actually work...for joe sixpack...the judge will listen to the officer, who says " I observed..." Done.
But you also have to remember besides the DUI...speeding, erratic operation of a motor vehicle, failure to yied for police,no license or insurance,(were not produced on the scene) should have been other charges...what they disappeared
obviously.

It seems that there are two kinds of laws practiced in Ontario - one for taxpayers and another (far more lenient) for the officers who are supposed to uphold the law.

This is why most people don't respect cops anymore. On the good side, at least the arresting officer had the ***** to charge him.

I think that sending the email to your federal MP won't do much as they don't care what goes on for the most part in ontario. You need to send these to your Ontario MPP.

Sadly life has to end for people to learn lessons. I would have liked to see the outcome if some judges daughter/son was killed by the officer in question.

Like most MP`s absolutely nothing...they`re just window dressing
It`s the principal at hand...being above the LAW
So contacting you MP may make you feel like you`ve tried...it`s ok
We all realize,nothing will change...especially if you don`t try
