I'm not a Lawyer....but....I believe earlier this year the Supreme Court of Illinois actually ruled that video and verbal recordings were allowed when the individual(s) did not have a reasonable expectation of privacy. Go figure. The most corrupt State in the Union actually did something right!!

there is an entire thread on this subject guys.

and all of the non lawyers keep spouting about how its unfair/doesn't make sense/whatever and repeatedly ignore the people here who are, in fact, lawyers.

If this isn't a reason to fire someone, I don't know what is. A tech intentionally screwing up a customers car, then laughing about it. He'd never work for me again!

I think the anger here is because of the threat the tech made about doing further damage to his car or not doing the repair correctly.

Sheesh.... I guess you don't understand....

He really is innocent because.... IF he had known he was being recorded, he wouldn't have said those things and incriminated himself. Thus, he would have only thought it...or mumbled it incoherently---and still screwed up his car. And then you couldn't prove anything....

While I respect your opinion and can understand your viewpoint, this tech is a person entrusted to work on brakes, airbags and all manner of safety related issues also. Even an alignment way out of whack is potentially dangerous. It's bad enough that an improper repair can be done by someone actually trying to do it right. What if a customer (even unintentionally) rubs the tech the wrong way by doing something even more heinous than blocking radio controls?

This recording, whether legal or otherwise, should be a hard lesson learned for the douchebag mechanic. I guarantee that ***** wouldn't have said anything of the sort had the OP been standing within earshot.

He only said it because he can. And he believes he can get away with it.

Not defending the guy, but remember that there is a difference between what people say and what they actually do. Just because this guy said xxx, doesn't mean he would actually do it.

A single incident like this should not get the guy fired, it has to be taken in context of his overall work and behavior.

If the guy is a competent tech (read "has some redeeming attributes") I'd give him a serious career/attitude adjustment session. Put his butt on probation, and arrange for him to personally apologize to the customer. If he cleans up his act, great. If not, show him the exit.

I'm in the 'get him fired' camp. Who want's someone with that kind of attitude working on their car? Or on anyone's car? Or anyone's anything? That guy has some serious growing up to do, and it's not going to happen if there aren't consequences for that kind of thinking. He's not ENTITLED to a position of trust, he has to earn it.
