Default Opened the mail today...

and from the dealer where I have the #6 allocation there is a check for the amount of my deposit and a note on the statement "refund on deposit"

I called the dealership and they said their finance guy didn't want to hold the $$'s because they can't actually place an order until BG calls them to confirm the allocation/order.

What's up with this? Does this sound right?

Either you have a small and very honest dealer, or you just got the "Hey bubba, we can sell these cars for 10K over! Screw them loyal customers lets do us a money grabbin scheme!"

Hate to think its the latter, but let us know.

IMHO it doesn't sound right. Why would they take your deposit in the first place when they didn't know what their allocation was going to be and now this is a problem? It would seem that they should first find out their allocation and then inform when you would get your car. Then they should give you the option of getting your deposit back if you decide the wait is too long.

I know some of the bigger dealers have an idea of allocations but I don't know about the smaller ones.

Also, was the deposit to buy a Z for MSRP? If so, this could be another reason why the dealer didn't want to go ahead will the future sale.

I gave a deposit check to Maxie Price about a year ago and they said they would not cash it until they placed the order. I think your dealer is playing games, just tell them to leave you on the list and not cash the check.

They do know what their allocations are...at least what GM sent them as "projections" in the June 15th letter. It shows 7 allocations through the end of the year and it's written on my vehicle buyers order that I have the 6th allocation and the letter is attached to my order.

As far as the $$, I know that in my business the finance guy won't let us collect revenue for services that we have not performed yet, even though our agreement specifically states that 50% of the fee will be paid upon signing the agreement...I beleive it's an accounting thing.

At least that's what I'm hoping. Any accountants out there that can comment?

They told me I was still on the list and still #6, I think I will hold on to the check for awhile...it's good for 180 days. Good advise.

Who knows what these dealers are up to. Assume the worst. Ask questions, but don't expect honest answers.

Make sure you have something in writting that says you are #6 and what the agreed price is. If you do and they don't give you the car then you have something to stand on. If you don't have anything but some person telling you, "you're on the list" then you might get screwed. Best of luck.

Have you talked to them in person yet (at least the General Sales Manager or above)?

I'd ask them these questions:

Are you still on the list as #6, and is that in writing?

Do they have deposits from the 5 in front of you? Depending on the answer, that would lead to ask why/why not.

I would also contact the Controller separately and ask him if that is, in fact a policy of the dealer, and if so, why did they take it to begin with, then return it.

You need a lot of answers, and a confirmation in writing as to where you stand.

I have talked to them, My sales contract in writting for the # 6 allocation is still valid and nothing has changed except they are not holding my deposit. They have 2 depsit for their 1st 2 allocations, of which I would imagine they are configuring for production.
