Dear Forum members. I may be a new member, but I'm a man of my word, an honest man with values tthat I hope to pass on to my children. With that being said. I had a verbal agreement with someone selling a car, as a matter of fact from the post he had been putting up he was getting desperate. He went from $7500 to $5000 in a months time. Well ,I contact him telling him "I WILL BUY THE CAR" He goes as far as e-mailing me a bunch of pics, address, bank info acct. and everything needed to complete the deal, and emails me the title to that car. This is Sunday "No Banking on Sunday" I tell him "Monday afternoon I will get the deal going and done", contact transport company,(did that Sunday night) get the car inspected,(he will do Tuesday) etc... Well you people getting the plot here? Thats right Eric Voigt screwed a fellow Forum member. Thanks somuch to Eric in California, and if someone has a 1992 to 1994 under 150,000 they want to sell to a member, any color but white, please let me know. I can understand your frustration, but desperate times sometimes call foor desperte measures. A local buyer probably stepped up with cash. On the other side of the coin, I've had a guy in Kansas City string me along for 4mo's. Has called three times saying he will be out the next week to drive the car home. If you are interested, I have a polo/beige 96 auto with 150k for $7200, you could drive it home.
Its just another sign of the times...I believe he has offered an apology to you on his F/S thread. Not that, that makes it right. I, like you, have very strong ethic's...my word is my bond. But, in Eric's defense...when someone has the monies (cash) laying at your feet...it would be hard to say no. After all, he had no proof from you that you would indeed follow through...other than your word of commitment. Be that as it may...it still sucks, and I feel bad for you that you did not get the car.....Look on the bright side, a better one will come along soon...for the same monies. Good luck on your search.
I have been holding back on responding to this for many reasons.
Normally, when I make deal, both verbially and, putting money down, that is it.
The car has been on the market for at least 3 months and until I dropped my shorts and and took it in the butt, did ANYBODY come forward and show me the cash.
Yesterday, and this is no lie, my phone rang off the hook until somebody from 5 miles from my home (and I told them I had a pending deal however, deposit was coming) came and brought dead presidents. My wife and I discussed this at great end, and bottom line was, was king. He is correct, I sent photos, copy of title etc.
Had this been any other deal, I would've held off. Everybody had fair shot at this, and if I remember my F/S add, it clearly stated "first with the cash takes it home".
I am not a schumk, crook, cheat or, anything else that might be alledged. Gary, I apologize as I did on the f/s post, email and phone and look at this way, I saved you $800-$1200.
I appreciate and support this forum and members to the highest regard. This situation is a economic of circumstances.
I do not want to start a forum war, nor, bash anybody. That is not my MO.

In Eric's defense I too was talking to him about the car. We had discussed pricing and a few other details but I did not commit b/c I was up in the air about an automatic when I really wanted a stick but the price was hard to resist. Plus I had to ship coast to coast.
The entire time we both kept open lines of communication and understood that if somebody came along with cash that was that. I think he did the right thing as anyone who has sold a car knows there are a lot of people who talk a great talk but few who put up. Eric is not a car dealer and does not have an open showroom and other sources of revenue to keep him afloat when all the tire kickers want to come out on a sunny day.
3 elements to a contract folks: offer; acceptance and consideration. The first 2 were filled but the 3rd was lacking.
Eric I would have done the same thing.

Sorry OP, I agree with the seller- if you wanted the car, you send cash deposit via paypal or however, all could be agreed upon that the inspection comes out ok. If the seller is willing to relinquish the deposit if something major pops up upon inspection, that deposit would have solidified your deal.
They buyer is out nothing but some time (we all spend that anyway looking for a car) and the seller could have been out a sale had he held it for you and something went wrong at your end.
